Terms of Service

These terms are a contract between you and APPCARTEL S.R.L. (Trade Register no. J2025073028003, CUI 52570322, Strada Principală 72P, Corușu 407056, Baciu commune, Cluj County, Romania; contact@profitday.app), which operates ProfitDay ("ProfitDay", "we", "us"). By creating an account or installing the ProfitDay app, you accept them.
1. The service
ProfitDay is a web app that reads data from your Shopify store and, if you choose, from your ad accounts, and combines it with costs you enter to show your sales, costs and profit by day.
2. Who can use it
ProfitDay is for businesses. You must be at least 18 and able to enter into contracts on behalf of the business you represent. You are responsible for everything done through your account and for keeping your sign-in details safe.
3. Your store and ad accounts
- You connect a store by installing ProfitDay from Shopify. You may connect only stores and ad accounts you are authorised to use.
- You authorise us to read the data described in our Privacy Policy from those accounts. We only read data; we never change orders, products or ads.
- Your use of Shopify, Meta, Google, TikTok and other platforms remains subject to their own terms.
4. Plans, trials and billing
- Plans are per store and are billed by Shopify through Shopify Billing, in US dollars. Current plans and prices are shown in the app and on our website.
- Paid plans include a 14-day free trial the first time a store chooses one.
- Plans are based on the store's number of orders in the last 30 days. If a store stays above its plan's limit for two months in a row, we will notify you and give you 14 days to upgrade. We never charge you extra automatically.
- You can change or cancel your plan at any time in the app. Charges, refunds and taxes on charges follow Shopify's billing terms.
5. Accuracy of the numbers
We work hard to make every number correct and explainable. However, ProfitDay depends on data from Shopify and ad platforms and on the costs and settings you enter. Tax amounts such as estimated profit tax are estimates.
ProfitDay is a management tool. It is not accounting, tax, legal or financial advice, and it does not replace your bookkeeping or your accountant. Check important figures before relying on them.
6. Acceptable use
You will not:
- break the law, or other people's rights, using ProfitDay;
- try to access another user's data, test or bypass our security without written permission, or overload the service;
- copy, resell or reverse engineer the service, except where the law allows;
- use automated means to access the service other than the features we provide.
We may suspend access that puts the service or other users at risk. We will tell you why, unless the law prevents it.
7. Your data
You keep all rights to your data. You give us permission to process it only to provide and improve the service, as described in the Privacy Policy and the Data Processing Agreement, which forms part of these terms.
8. Our rights
ProfitDay, its software, design and brand belong to APPCARTEL S.R.L. These terms give you a right to use the service, not ownership of it. If you send us feedback, we may use it without obligation to you.
9. Availability and changes
We aim to keep ProfitDay available at all times but cannot guarantee it will be uninterrupted. We may change features. If a change materially reduces what you pay for, we will tell you in advance and you may cancel.
10. Liability
- We provide the service "as is". To the extent the law allows, we exclude all implied warranties.
- We are not liable for indirect or consequential losses, lost profits, lost revenue or lost data, or for decisions you make based on the numbers shown.
- Our total liability in any 12-month period is limited to the amount you paid us for ProfitDay in those 12 months.
- Nothing in these terms limits liability that cannot be limited by law, such as liability for wilful misconduct or gross negligence.
11. Ending the contract
You can stop at any time by uninstalling the app from your stores and deleting your account in Settings. We may end these terms with 30 days' notice, or immediately if you seriously breach them. After termination we delete your data as described in the Privacy Policy.
12. Changes to these terms
We may update these terms. We will tell you about material changes at least 30 days before they apply. If you continue to use ProfitDay after that, the new terms apply.
13. Law and disputes
These terms are governed by Romanian law. The courts of Cluj-Napoca, Romania, have jurisdiction, unless mandatory law gives you the right to another court.
